By using ThanksBusDriver.com ("the Platform", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform. We reserve the right to update these Terms at any time; continued use constitutes acceptance of the updated Terms.
You must be at least 18 years old to register as a driver or to send a thank‑you. By using the Platform, you represent and warrant that you are 18 or older. If you are under 18, you are prohibited from using the Platform.
Drivers must provide accurate, complete, and current information during registration, including full name, company, email, photo, and badge/ID. You are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
All driver registrations are subject to verification and approval by the Platform. We reserve the right to reject, suspend, or deactivate any registration for any reason, including but not limited to incomplete information, suspected fraud, or failure to prove affiliation with a legitimate school or transport company.
5.1 Points: Points are awarded to drivers when a user sends a thank‑you with a paid transaction. Points have no cash value, are non‑transferable, and cannot be exchanged for real currency. Points are not a form of currency and are solely a measure of appreciation within the Platform.
5.2 Redemptions: Points may be redeemed for physical items listed in the Platform's wishlist, subject to availability, stock levels, and administrative approval. Redemption requests are not guaranteed; we may reject any request if the item is out of stock, discontinued, or if the driver's account is flagged for review. All redemptions are final and cannot be reversed once approved.
5.3 Shipping: Redemption items will be shipped to the address provided by the driver during the redemption process. Shipping costs, if any, will be clearly communicated before finalising the redemption. We are not responsible for delays caused by third‑party shipping carriers or for lost or damaged items after shipment.
5.4 Points Expiry: We reserve the right to expire points if a driver's account is inactive for 12 consecutive months. We will notify you via email before points expire.
Users who send a thank‑you make a payment via Stripe. The payment amount corresponds to the point value selected (e.g., $5 = 5 points). Stripe processes all payments; we do not store credit card or payment details. We are not liable for Stripe's processing errors but will assist in resolving any payment issues. All payments are final and non‑refundable except as stated in our Refund Policy.
To maintain the Platform, we deduct a fixed fee of 2 points from each driver's balance on the 11th of each month, provided the balance is at least 10 points. If the balance is below 10 points, no fee is deducted until the balance reaches 10 or more. This fee is not a cash charge; it is deducted from points already earned.

We may terminate or suspend your account immediately, without notice, if you violate these Terms, engage in fraudulent activity, or if we determine that your use of the Platform poses a risk to others. Upon termination, all points and redemption requests are forfeited and no refunds will be issued.
All content on the Platform, including logos, designs, text, graphics, and software, is owned by us or our licensors. You may not reproduce, modify, or create derivative works without prior written permission.
The Platform is provided "as is" and "as available". We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non‑infringement. We do not guarantee that the Platform will be uninterrupted, error‑free, or secure.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of points, inability to redeem, or any payment disputes. Our total liability shall not exceed the amount you paid to us in the six months preceding the claim.
You agree to indemnify, defend, and hold harmless ThanksBusDriver.com, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your misuse of the Platform.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be resolved through binding arbitration in accordance with the Arbitration Act of Ontario. The arbitration shall be conducted in the City of Toronto, Ontario, Canada, by a single arbitrator. The language of the arbitration shall be English. Each party shall bear its own costs of arbitration, unless the arbitrator decides otherwise. You agree that any arbitration must be brought on an individual basis; class arbitrations and class actions are not permitted.

2.2 Automatically Collected Information: We use sessionStorage (similar to session cookies) to maintain your login session and preferences. We do not use tracking cookies, analytics cookies, or any third‑party tracking tools. We do not collect IP addresses, device information, or browsing history.
2.3 Payment Information: All payments are processed by Stripe. We do not receive or store your credit card details, bank account numbers, or other financial data. Stripe’s privacy policy governs their handling of your payment information.
We do not sell, rent, or trade your personal information. We share your information only in the following limited circumstances:

If you close your account, we will delete your personal information within 30 days, except where we are required to retain certain data for legal or regulatory purposes (e.g., transaction records).

We use sessionStorage to store a temporary session identifier (token) that allows you to remain logged in. This data is stored only in your browser and is automatically cleared when you close the browser window. We do not use persistent cookies, tracking cookies, or any third‑party advertising technologies.
The Platform is not intended for individuals under 18 years of age. We do not knowingly collect personal information from anyone under 18. If we discover that we have collected such information, we will delete it immediately.

ThanksBusDriver.com sells digital services – specifically, the ability to send a thank‑you to a driver and award points through a paid transaction. Points themselves are not sold, and redemptions are not purchases. This Refund Policy applies solely to the payment made to send a thank‑you.
Once a thank‑you payment has been successfully processed and points have been awarded to the driver, the transaction is considered final. We do not offer refunds for completed transactions, including where:
If a payment error occurs – such as a double charge, a technical glitch that prevents points from being awarded, or an incorrect amount being charged – we will investigate promptly. If we confirm that an error has occurred on our or Stripe’s side, we will issue a full refund to the original payment method. Please contact us within 30 days of the transaction to report such issues.
If a refund is approved, we will process it through Stripe back to the original payment method. Refunds typically appear on your statement within 5‑10 business days, depending on your bank or card issuer.
If you believe a charge is unauthorised or incorrect, you should contact us first. We will work with you and Stripe to resolve the issue. Filing a chargeback without contacting us may delay resolution and may result in your account being suspended.
