Welcome to ThanksBusDriver ("we," "our," or "us"). By using our platform, you agree to these Terms of Service. If you do not agree, do not use our service.

2. Acceptance of Terms

By registering for or using ThanksBusDriver, you accept these terms. We may update them from time to time; continued use constitutes acceptance.

3. Driver Registration

To register as a driver, you must provide:

• Full legal name
• Company affiliation
• Valid email address
• A valid company badge or ID (photo upload)
• A recent selfie (photo upload)

All information must be accurate and truthful. We reserve the right to reject or deactivate accounts that violate these terms.

4. User Conduct

Users agree to:

• Use the platform to send genuine thank‑you messages and points to bus drivers
• Not post inappropriate, abusive, or misleading content
• Respect the privacy of drivers and other users
• Not attempt to bypass security features (including JWT tokens)

5. Points

Points are awarded to drivers upon successful payment confirmation from Helcim. Points are:

• Non‑transferable between drivers
• Not redeemable for real currency
• Valid only within the ThanksBusDriver platform

5.1. Points Balance

Your points balance reflects the total points you have earned from thank‑you messages. You can view your balance at any time on your driver dashboard.

5.2. Platform Maintenance Fee

To help cover the ongoing costs of operating the ThanksBusDriver platform (including hosting, database, and payment processing), a monthly maintenance fee of 2 points is deducted from your points balance.

• This fee is deducted only if your balance is 10 points or more at the time of deduction.
• If your balance is below 10 points, no deduction is made for that month.
• You are never charged cash or credit card fees for this maintenance fee – it is deducted solely from the points you have already earned.
• The deduction date is the 11th of each month.

5.2.1. Fee Adjustments

We reserve the right to adjust the amount of the monthly maintenance fee at any time. If we make a change, we will:

• Provide notice at least 30 days in advance via email or a prominent notice on your driver dashboard.
• Apply the new fee only to the month following the notice period.

Continued use of the platform after the adjustment takes effect constitutes your acceptance of the new fee.

5.3. Redemptions

Drivers may redeem points for items listed in the Wishlist. Redemption requests are:

• Subject to item availability
• Managed by the administrator
• Subject to status changes: pending → on‑hold → fulfilled

Points used for redemption are deducted from the driver's balance immediately. Refunds of points for redemptions are at the sole discretion of the administrator.

6. Purchasing Points & Payment

Users (senders) may purchase points to award to drivers. Points are purchased at 1 point = $1.00 CAD.

6.1. Payment Processor

All payments are processed by Helcim Inc., a third‑party payment gateway. Your payment details are handled solely by Helcim; we do not store credit card numbers, expiry dates, or CVVs.

6.2. Transaction Fees

A standard credit card processing fee (visible before checkout) is added to your total. This fee is charged by Helcim. ThanksBusDriver does not keep this fee – it is a direct pass‑through.

6.3. Points Award

Points are awarded to the selected driver immediately upon successful payment confirmation from Helcim. Points cannot be withdrawn or exchanged for cash by the driver.

7. Account Deactivation & Deletion

Drivers may request account deactivation at any time. Deactivation sets your account to inactive – you cannot log in or appear in search, but your data is retained for record‑keeping. You may also request permanent deletion of your account; upon deletion, your personal data will be removed from our active systems within 30 days.

8. Data Security

We use industry‑standard security measures, including JWT (JSON Web Token) authentication, to protect your account and data. You are responsible for keeping your login credentials confidential.

9. Disclaimer

ThanksBusDriver is provided "as is" without warranties of any kind. We are not responsible for any damages arising from the use of our platform.

10. Governing Law

These terms are governed by the laws of Canada and the province of Ontario.

11. Changes to Terms

We reserve the right to modify these terms at any time. Continued use constitutes acceptance of the updated terms.

• Payment Information: We do not collect or store credit card numbers, expiry dates, or CVVs. All payment details are transmitted directly to our payment partner, Helcim Inc., via their secure payment page.
• Transaction Data: We store Helcim transaction IDs, amounts, and dates for reconciliation purposes.
• Usage Data: How you interact with our platform (e.g., logins, redemption requests).

3. How We Use Your Information

Your information is used to:

• Register and verify driver accounts
• Process thank‑you messages and point redemptions
• Communicate with you about your account (e.g., approval, redemption status)
• Ensure platform security and prevent fraud
• Comply with legal obligations

4. Payment Processing (Helcim)

We do not collect, store, or process any credit card or banking information on our servers. When you make a payment to purchase points, your payment details are transmitted directly to Helcim Inc., a PCI‑compliant payment processor. 5. Data Storage & Retention

Your data is securely stored in AWS DynamoDB and S3, located in the ca‑central‑1 (Canada) region. We retain your personal information only as long as necessary to fulfill the purposes outlined in this policy, or as required by law. If you request account deletion, your data will be removed from our active systems within 30 days.

6. Consent

By using ThanksBusDriver, you consent to the collection and use of your personal information as described in this policy. You may withdraw your consent at any time by contacting us.

7. Information Sharing

We do not sell or share your personal information with third parties, except:

• When required by law or legal process
• With your explicit consent
• To service providers who assist in our operations (e.g., AWS, Helcim) – all with strict confidentiality agreements

2. Payment Processing & Helcim Fees

All credit card payments are processed securely by our third‑party partner, Helcim Inc. When you purchase points, you agree to pay the base amount for the points plus the applicable Helcim processing fee (clearly displayed to you before checkout).

Important: The processing fee is charged directly by Helcim to facilitate the secure transaction. ThanksBusDriver does not keep this fee – it is a direct pass‑through to Helcim.

3. Digital Goods (Points)

Points are considered digital goods. Once a transaction is successfully approved by Helcim and the points are awarded to the driver, the sale is final and non‑refundable. Points cannot be transferred back to the sender or exchanged for cash.

4. Technical Errors or Duplicate Charges

In the rare event of a duplicate charge or a system error where points are not awarded despite a successful charge:

• Contact us at thanksbusdriver2026@gmail.com within 14 days.
• We will investigate with Helcim.
• If we confirm an error on our end (e.g., points not awarded due to a system failure), we will issue a full refund of the total amount paid (including the Helcim processing fee) or manually award the points.
• If the error is on the cardholder's end (e.g., accidental double‑click or duplicate submission), we reserve the right to refund only the base amount of the points, as the Helcim processing fee is typically non‑refundable by the payment processor.

5. Disputes

If you believe a transaction was processed in error, please contact us immediately. We will work with you and Helcim to resolve the issue fairly.
